We’re glad you’ve been invited to join one of our KWTH members for a waterfowl hunt.

 

KWTH operates on privately leased farmland made available through trusted, long-standing relationships with local landowners. Every guest plays an important role in protecting that access by hunting safely, ethically, and with respect for both the property and the people who make it available.

 

Before your hunt, please review and complete the required steps below.

This Agreement is made by the undersigned participant (“Participant”) in favor of Know Where To Hunt Waterfowl Club (“KWTH”) and its affiliates and participating landowners (collectively, the “Released Parties”).

 

  1. Acknowledgment and Assumption of Risk - Participant understands that waterfowl hunting and related outdoor activities involve inherent risks, including firearm discharge, drowning, uneven or hazardous terrain, and the actions of other participants. Participant voluntarily assumes all risks of injury, death, or property damage arising from participation in KWTH activities.

  2. Release of Liability - To the fullest extent permitted under Washington law, Participant releases and agrees not to sue the Released Parties for any claims arising out of participation in KWTH activities, including claims based on ordinary negligence. 

  3. Indemnification- Participant agrees to defend and indemnify the Released Parties from any claims, damages, liabilities, or expenses (including reasonable attorney’s fees) arising from Participant’s actions or omissions, violation of club rules, violation of state or federal law, or injury or damage caused by Participant.

  4. Compliance and Property Conditions - Participant agrees to comply with all applicable hunting laws and KWTH rules, maintain required licenses, and accepts all risks associated with entering privately leased agricultural property. 

  5. Photo and Media Release - Participant authorizes KWTH to use photographs or video of Participant for promotional purposes without compensation, and releases KWTH from any related claims.

  6. Landowner Relationship Protection (Non-Circumvention) - As a condition of participation, Participant agrees not to contact or attempt to lease any property introduced through KWTH, interfere with KWTH’s landowner relationships, or use non-public information for personal or competitive purposes. These obligations apply during participation and for five (5) years after termination. KWTH may seek injunctive relief, damages, and attorney’s fees for any violation.

  7. Governing Law; Severability - This Agreement is governed by the laws of the State of Washington. Any legal action shall be brought in Washington State. If any provision is found unenforceable, the remaining provisions shall remain in effect.

  8. Acknowledgment - Participant certifies that he or she is at least 18 years old (or parent/guardian signing below), has read and understands this Agreement, signs voluntarily, and understands that substantial legal rights are being waived.
