In consideration of being allowed to hunt as a guest through Know Where To Hunt, I voluntarily agree to release and discharge Know Where To Hunt, its owner, any landowners whose properties are leased by Know Where To Hunt, and any agents, employees, or volunteers acting on behalf of any of the foregoing (collectively referred to as the “Releasees”).
This release is made on behalf of myself, my spouse, my children, and our heirs, successors, assigns, personal representatives, and estate. I understand and agree that this release applies to me individually and to all parties listed above, and I agree to the following terms:
I acknowledge and understand that hunting activities, including but not limited to the use of firearms and all-terrain vehicles (collectively, the “Activities”), involve inherent and potentially serious risks, both known and unknown. These risks may include, but are not limited to, physical or emotional injury, paralysis, death, or damage to myself, my property, or the property of others.
I understand that hunting conditions may include limited visibility, uneven or difficult terrain, standing or moving water, wildlife hazards, and the presence of other hunters. I affirm that I have sufficient experience and understanding to recognize and appreciate these risks. I agree to wear appropriate safety gear and to conduct myself in a safe and responsible manner at all times.
I HEREBY KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME FULL RESPONSIBILITY FOR ALL RISKS ASSOCIATED WITH THE ACTIVITIES DESCRIBED ABOVE, WHETHER FORESEEABLE OR UNFORESEEABLE, AND I CHOOSE TO PARTICIPATE DESPITE THESE RISKS.

I acknowledge that participation in waterfowl hunting requires a certain level of skill, knowledge, experience, and the use of appropriate protective and safety gear. I represent that I possess, or accept full responsibility for obtaining, the skills, knowledge, experience, and equipment necessary to safely participate in these activities.
I further acknowledge and agree that I am solely responsible for obtaining and maintaining all required Washington State hunting licenses, permits, and certifications necessary to legally hunt waterfowl. I agree to comply with all Know Where To Hunt rules and policies, as well as all applicable state and federal hunting laws and regulations.

As consideration for being permitted access to and use of the premises on which hunting activities occur, and for participation in one or more hunting-related activities, I agree that I, my spouse, my children, and our respective heirs, assigns, successors in interest, guardians, and legal representatives will not make a claim against or file a lawsuit against the Releasees.
This includes any claims for injury, death, or property damage arising from or related to the negligence or other acts or omissions of the Releasees, to the fullest extent permitted by law, whether such claims result from my access to or use of the premises or my participation in any of the activities.
I hereby fully and forever release, waive, and discharge the Releasees from any and all actions, claims, demands, or causes of action, whether known or unknown, that I or the parties listed above now have or may have in the future arising out of or related to access to or use of the premises or participation in the activities.

By signing this Agreement, I acknowledge and understand that if any person is injured or property is damaged during my access to or use of the Premises and/or participation in any of the Activities, I may be found by a court of law to have waived my right to bring a lawsuit against the Releasees for any claim that I have released under this Agreement.
Attorneys’ Fees - If the Releasees, or anyone acting on their behalf, are required to incur attorneys’ fees or legal costs to enforce this Agreement, I agree to indemnify and hold the Releasees harmless from all such fees and costs.
Insurance, Indemnification & Physical Condition - I represent that I have adequate insurance coverage to cover any injury or damage that I may cause or suffer while accessing the Premises or participating in the Activities, or I agree to personally bear all costs of such injury or damage. I further agree to indemnify, defend, and hold harmless the Releasees from any claims, actions, damages, losses, or liabilities arising from my actions on the Premises or participation in the Activities. I represent that I do not have any medical or physical condition that would interfere with my safe participation in the Activities. If such a condition exists, I knowingly assume and accept all risks and costs associated with that condition, whether direct or indirect.
No Warranty I acknowledge that the Releasees make no representations or warranties, express or implied, regarding the condition, safety, or suitability of the Premises or any services provided. I understand that no warranty is given that the Premises are safe, free from hazards, or fit for my intended use.
Term and Refusal of Access This Agreement is valid only for the applicable waterfowl season specified and shall automatically terminate without notice at the end of that season. Notwithstanding anything to the contrary, the Releasees reserve the right to refuse or revoke access to the Premises or participation in any Activity by any person at any time. If any portion of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect. Paragraph headings are provided for convenience only and do not limit or control the interpretation of this Agreement.
I acknowledge that I have had sufficient opportunity to read this entire Agreement, that I fully understand its terms, and that I voluntarily agree to be bound by them.
